央视网消息（网络新闻联播记者 王甲铸报道）7月31日下午，药家鑫父亲药庆卫诉张显名誉侵权案在西安雁塔法院开庭宣判，要求被告张显在判决生效后立即停止侵权行为，在3日内删除微博和博客上的造谣诽谤言论，于判决生效之日起10日内在其新浪微博、新浪博客上连续三十日分别刊登致歉声明（声明内容须经法院审查，刊登期间不得自行删除），向原告药庆卫赔礼道歉，消除影响，另外张显须向药庆卫支付1块钱的精神损害抚慰金。
在药家鑫案终审后，其父药庆卫认为王辉代理人张显在微博上编造了许多子虚乌有的事实，把药家鑫说成“官二代”或“富二代”，意在让广大不知情的网民产生仇恨。2011年8月4日，药庆卫向法院提起诉讼，状告张显名誉侵权。9月5日下午，药庆卫又向法院增加了两项诉讼请求：要求张显连续30天在知名网站、报刊等新闻媒体上刊登不少于 3000字的致歉声明，并赔偿精神损害抚慰金1元。
此后，张显回应称：“我不会道歉的……药家鑫父母因没有教育好自己孩子，残忍地杀害了张妙，应向我方道歉的……药家鑫父母也应该向全国有良知的人道歉的。”
2011年12月29日下午，该案在西安雁塔法院开庭审理。庭审结束，原告拒绝调解，法庭宣布择日宣判。
被告张显在判决生效后立即停止侵权行为，在3日内删除网址为http://weibo.com/1050645044的微博网页上，被告张显于2011年6月17日17时10分发表的微博1条；在3日内删除网址为http://blog.sina.com.cn/u/1050645044名为“晴朗的天空”的博客网页上，被告张显于2011年6月4日16时34分转载的题目为《从余则成到自摸——药家痔馕的拙略》、2011年8月16日13时23分转载的题目为《没有真相就是最大的谣言；从央视柴静选择性眼瞎》博文2篇。于判决生效之日起10日内在其新浪微博、新浪博客上连续三十日分别刊登致歉声明（声明内容须经法院审查，刊登期间不得自行删除），向原告药庆卫赔礼道歉，消除影响，另外张显须向药庆卫支付1块钱的精神损害抚慰金。
判决前药庆卫发公开信 称相信法律并再次对受害人致歉
回顾我诉张显名誉侵权案一年多的时间，我的生活犹如人间炼狱，尝遍了世间冷暖、酸甜苦辣，我为药家鑫犯下的滔天罪行和对受害者家人犯下的伤害感到深深的自责。军人的“舍小家为大家”的职业特点，使我在服役期间，与孩子聚少离多，不能像其他家庭那样陪着孩子。去享受天伦之乐。我爱人身体不好，还要肩挑生活重担。探亲的时候，我只能拼命地多干家务。对于孩子只能将父爱深深地藏在心里，更严格地要求他，希望他尽快成长，当我离家在部队的时候，他能听妈妈的话。我出生在偏远农村，成长于部队，我十分爱我的家，爱我的爱人和孩子。可我从来不善于表达我的感情，以至于在孩子犯罪后，在生离死别的最后时刻，我才喊出了藏在心里很久的话，“孩子我也爱你！”。我知道这句话再不说就没有表达的机会了。
在网络上经常有人批评我“子不教、父之过”。我在深深的自责中责备自己。如果我不是军人，我会天天关注孩子，关注他的一举一动，也许可以避免他给受害者、给社会造成的伤害；如果我不是军人，就能在家好好照顾家庭，就不会让爱人和孩子独自承当生活的重担，也不会让孩子童年缺少父亲的陪伴和爱护；如果我不是军人，而多一点慈言善语，能给予他更多的“我爱你！”就不会对他有更高更严的要求！这些也许，现在只是伴着睡梦中的泪水和懊悔......但是，作为一名守法的退役军人，我依然无怨无悔，我真诚地提醒还在服役的战友们，“顾大家”的时候，有机会多陪陪孩子，一定要对孩子说：“我爱你！”。
我非常感谢雁塔法院在案件审理期间为调解付出的辛勤劳动，我与张显打这场官司，只是想让张显澄清强加在我和我家庭身上的不实之词，只需要张显一个真诚的道歉。孩子走上犯罪的不归路，作为父亲我已陷入深深的愧疚、自责之中。但是作为一名将青春年华献给部队的普通退役军人，在长达一年多的时间里。我不仅沉浸在巨大的痛苦中，还要忍受张显和他的网络支持者的侮辱。2012年春节前，我已基本同意法官提出的“和解”方案。可是，我的这些隐忍换来的却是更大的伤害。张显和网民“路肩不平”、赵满福律师、“皇城御猫001”整天在网络上侮辱谩骂我，还将这起普通的案件政治化、权贵化、更是将我妖魔化、恣意侮辱谩骂。尤为恶劣的是张显还残忍挑起两个受害家庭的争斗，还大呼小叫的“要围观、看笑话”......我相信法律、送子投案；我相信法律，将张显诉至法院；现在我依然相信法律，希望法院能在查明事实的基础上，作出公正的判决！
我再次对受害家庭表达最诚恳的道歉，也对长期支持我们的网友表达最诚挚的感谢！是你们让我和爱人感到没有被社会抛弃，也感到这个社会还有正义、温暖和包容；更要感谢法庭给了我能在公平、公开场合说话的机会。
