抗战北路亚龙湾浴场
鹏鹏和父亲到派出所报警
长江商报消息 拿着朋友送的免费洗浴票，家住陕西咸阳的陈女士一家和朋友胡女士一家，第一次踏进洗浴广场。7月31日上午，当两家人准备结账离开浴场时却被告知，陈女士13岁的儿子鹏鹏，在浴场内消费了由技师提供的“性服务”，浴场要求陈女士为鹏鹏消费的198元买单。昨日，咸阳市公安局渭城分局组成专案组，对“亚龙湾浴场”违法违规行为进行立案调查。
浴场凭什么向一个13岁的孩子提供性服务？在得到浴场女技师确实为鹏鹏提供过“性服务”的答复后，愤怒的陈女士当即选择了报警。
孩子“被性服务”
31日中午12时20分许，做完报案笔录的鹏鹏和父亲孟先生、胡女士一起，从咸阳市公安局渭城分局新兴路派出所内走出。鹏鹏一直低着头，说起上午发生的事情，孟先生和胡女士仍觉得不可思议。
孟先生说，前段时间朋友给了几张抗战北路亚龙湾浴场的洗浴票。7月30日天气炎热，他便和胡女士一家相约，带着各自的孩子一起到浴场洗浴。因为工作原因，30日下午6时许，陈女士和胡女士二人先带着鹏鹏和胡女士15岁的女儿一起来到浴场，孟先生和胡女士的丈夫刘先生随后赶到。
当晚，两家人在浴场洗完澡后，便在休息大厅休息。当日上午8时许，因为要上班，孟先生和刘先生先行离开了浴场。“没想上班没多久，我接到妻子的电话，说孩子‘被性服务’了。我听后简直不敢相信自己的耳朵，撂下电话便往浴场跑。”孟先生说。
技师承认提供性服务
到浴场后，妻子告诉孟先生，早上9时左右，她和胡女士带着两个孩子准备结账离开时，收银员说他们有一张198元的按摩消费单，是由鹏鹏消费的，实际内容是性服务。
胡女士昨日下午说：“即便浴场的人这样说了，我们还是觉得不能相信，一个13岁的孩子，怎么可能有这样的消费！追问之下，鹏鹏承认了确实有个女技师给他提供了性服务，消费单上的字是他签的。在我们的一再要求下，浴场经理找来了给鹏鹏提供性服务的‘51号技师’。对方在房间内也当着我们和浴场经理的面承认，她给鹏鹏进行过性服务。我们质问她为什么要给一个孩子提供这样的服务，她一直不说话，后来就离开了包间。这时，浴场提出给我们减免一半的费用，但很明显，这根本不是钱的问题。”
孟先生在了解了事情原委后，当即选择了报警。鹏鹏户口本上显示，他出生于1999年。
4名涉案人员已被调查
昨日，咸阳市公安局渭城分局组成专案组，对“亚龙湾浴场”违法违规行为进行立案调查，责令浴场停业整顿，同时对4名涉案人员进行了调查，因涉案女技师逃离浴场，专案组现正在全力追查。
昨日下午，鹏鹏在警方的陪同下，再次前往浴场，对事发现场进行了指认。随后，在其父亲孟先生带其到医院进行了身体检查。

“问过我年龄后她脱光了衣服”
站在派出所门口，眼前的鹏鹏虽然有接近1.8米的身高，但一脸稚气的他看上去明显还是个孩子。
记者：那件事（被性服务）是怎么发生的？
鹏鹏：到浴场后，我妈她们在女部洗澡，我一个人在男部洗。我洗完后，换了浴服准备到大厅休息。刚走到门口时，浴场的一个男服务生过来问我需不需要按摩，我以为这项服务包含在我们的洗浴票里，就“嗯”了一声点了下头。然后，男服务生便把我带到4楼的一个房间。我在里面坐了会儿，一个女服务生拿了一张单子进来让我签，我签了后感觉不对劲，想回到三楼大厅，却发现四楼通往三楼的铁门推不开。
记者：然后你又返回房间了吗？后来又发生什么了？
鹏鹏：我只得又返回房间。过了两三分钟，一个女的进了我的房间，说了几句话后，她把自己的衣服全都脱了躺在床上，我控制不住，把自己的衣服也脱了，她给我戴了避孕套，并和我发生了性关系。大约15分钟后，我下楼回到了休息大厅。
记者：你们说话时，那个女的问你的年龄了吗？
鹏鹏：她没脱衣服前，问了我的年龄，我说13周岁。她听了后，也没说什么，接着就开始脱衣服了。(来源：长江商报)

男性被性侵无法律规定
中国政法大学法学院何兵教授说，我国现行法律中，“强奸”仅针对女性，而针对男性，并没有对其性侵犯的明文法律。
根据《治安管理处罚法》，浴场和女技师的行为，是典型的提供色情服务及卖淫行为，应该对此采取相应制裁措施。此案的恶劣影响在于，13岁的鹏鹏是一个没有行为能力和辨别能力的个体，对其提供性服务，无异于对未成年个体的摧残。对于鹏鹏而言，因为年龄只有13岁，其本身并不构成刑事和行政违法。据华商报
