原标题：重伤车主起诉西安市公安局“不作为”
“9·15”西安反日游行中受重伤的日系车主李建利委托律师，将于今天向西安市莲湖区法院提交行政起诉状，起诉西安市公安局“不作为”。
在行政起诉书中，原告李建利认为，作为游行示威的主管机关西安市公安局的职责，是在游行示威前必须有详细的预案并配备足够的警力保证公民集会游行示威的有序进行。尤其是在西安市已经发生过几次集会游行打砸事件的情况下，公安机关更应当高度重视，既要保障公民集会游行示威的表达权利，又要保证在游行示威的过程中不发生妨碍社会秩序、侵犯公民人身和财产权益的违法事件。“但是，在2012年9月15日游行的第一天，在西安市发生了数量众多的违法侵害公民人身和财产违法行为。从始至终，我们看不到我们的人民警察迅速而有效的反应。在原告车辆被砸自己被击伤之前，打砸抢事件已经持续了很长的时间，原告并没有看到有警察出来维持秩序，或者说出现的极少量警察根本不足以制止打砸抢违法行为。因此，原告无论是从事前保证游行正常有序进行的合理预案，还是从打砸抢出现后作为公安机关应有的反应来看，被告都属于严重的不作为行为。对于被告严重的不作为行为给原告造成的损失，被告依法理应予以赔偿。”
原告李建利也在起诉书中提到，被告西安市公安局的相关人士事后曾来到医院看望原告，也拿出两万元慰问，但是，这种事后态度和行为，“远远不能说明被告的不作为行为是合法正确的，远远不足以弥补和慰藉由于歹徒的行凶以及被告的不作为给原告造成的创伤和损失。”
李建利的代理律师段万金律师表示，西安市公安局在“9·15”反日游行中存在不作为的情况，原告的受伤也与此有关，他会尽力帮助原告维护其合法权利，希望法院能够依法判定被告的不积极作为行为违法；同时要求被告赔偿原告医药费、残疾赔偿金、财产损失等暂定共计50万元，因为李建利的预后费用不好估计。
目前法院尚未正式立案，根据相关法院立案程序规定，法院审查起诉材料后，应当在七日内立案，认为不符合立案条件的，应当作出书面的不予立案通知书。
李建利及其家人起初并不想去“民告官”，但是，这次事件对他们造成的伤害超出了承受能力，不得不鼓起勇气，拿起法律武器主张权利。不过，他们对事发后伸出援手、积极侦破案件的警察、交警、出租车司机非常感谢。昨天，李建利妻子王菊玲女士特意向西安市公安局莲湖分局刑警大队、环城西路派出所、西安市交警支队莲湖大队和西安市出租车管理处赠送了锦旗。据警方人士介绍，在将李建利一案的犯罪嫌疑人刑事拘留之后，目前处在进一步调查阶段。(来源：北京青年报)
